Terms of Service

The rules for using PhotonForge and photonforge.io.

What this is

PhotonForge is a suite of developer tools operated by Horizon Digital Engineering LLC ("we", "us"), a Florida limited liability company. By visiting photonforge.io or using the PhotonForge product, you agree to these terms. If you don't agree, please don't use it.

Account terms

To use the product (beyond browsing the marketing site), you need an account. You agree to:

  • Provide accurate information at signup.
  • Keep your credentials secure; you're responsible for activity under your account.
  • Notify us immediately of any unauthorized use you become aware of.
  • Be at least 13 years old (or the age of digital consent in your jurisdiction, whichever is higher).

Acceptable use

You may not use PhotonForge to:

  • Violate any law or regulation.
  • Send spam, scam content, malware, or phishing.
  • Infringe anyone's intellectual property or privacy.
  • Probe, scan, or attack the service or other users.
  • Resell or sublicense access without our written agreement.
  • Use the service to operate a competing devtools product (i.e. reverse-engineer-then-rebrand).

We reserve the right to suspend or terminate accounts that violate these rules. We'll usually give you a chance to fix it first, unless the violation is severe (security attack, illegal content).

Your content

You own the content you put into PhotonForge — status page text, incident reports, configuration data, integrations, etc. You grant us a non-exclusive license to host, process, and display it as necessary to operate the service for you.

We don't claim ownership of your content. We don't sell or commercialize it. We may surface anonymized aggregate metrics (e.g. "X% of customers use Y integration") for product analytics; nothing user-identifying.

Our content + intellectual property

The PhotonForge product, photonforge.io website, source code, UI, branding, and logos are © Horizon Digital Engineering LLC unless explicitly marked otherwise. The PhotonForge name and logo are trademarks of HDE.

Any open-source components are governed by their own licenses; those licenses are not modified by these terms.

Service availability

We aim for high availability but don't guarantee uninterrupted service. We may schedule maintenance, deploy updates, or experience outages. For paying customers on a plan that includes an SLA, terms of that SLA take precedence over this section.

Pricing + billing

PhotonForge is currently in early access. If you become a paying customer:

  • Prices and what they include are shown at signup and in your account.
  • Subscriptions auto-renew unless you cancel before the next billing date.
  • Refunds: we offer pro-rated refunds for downgrades within 30 days of an upgrade. After 30 days, refunds are case-by-case.
  • We use Stripe for payment processing.

No warranty

PhotonForge is provided as-is, without warranty of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that the service will be error-free, uninterrupted, or that all defects will be corrected.

Limitation of liability

To the extent permitted by law, Horizon Digital Engineering LLC is not liable for indirect, incidental, consequential, special, or punitive damages arising from your use of PhotonForge. Our total aggregate liability for any direct damages is capped at the greater of (a) US$100 or (b) the amount you've paid us in the 12 months preceding the event giving rise to the claim.

Indemnification

If your use of PhotonForge (especially in violation of these terms) causes us legal exposure, you agree to cover reasonable attorneys' fees and direct losses related to defending or settling the resulting claim.

Termination

You can terminate your account at any time from account settings. We can terminate accounts for violation of these terms with reasonable notice (or immediately for severe violations).

On termination: we'll delete your account data within 90 days, except where retention is required by tax/legal obligation. You can export your data via our API or by contacting us before deletion.

Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Disputes go to the state or federal courts located in Florida.

Changes

We may update these terms. The "Effective" date at the top shows when. For material changes we'll surface a notice in-product or email active customers. Continued use after a change means you accept the updated terms.
